DUBAI 8 April 2017: President of the UAE, His Highness Sheikh Khalifa bin Zayed Al Nahyan, issued a Federal Law No. (5) for the year 2012 regarding combating IT crimes and included amendments to the provisions of Federal Law No. (2) for the year 2006.

Punishable by Law

State: Use of information technology means to overthrow or change the regime of the State or to seize it or to disrupt the provisions of the Constitution or the laws in force in the country. Same punishment shall be imposed on anyone who calls, promotes or instigates any of the said acts or facilitates them to others.

Demonstrations: Anyone who uses the information network or an information technology device to plan, organize, promote or advocate demonstrations, marches or the like without the authorization of the competent authority shall be punished by imprisonment.

Illegal Art: Anyone who uses the information network or an information technology device to trade in antiquities or works of art shall be penalized in prison other than those authorized by law.

Broadcast: Any person who has benefited or facilitated the use of telecommunications services or audio or visual broadcasting channels without any right.

Religion: The decree also punishes anyone who uses the Internet or an information technology device to abuse a holy shrine or Islamic ritual or the divine self or to the same messengers and prophets as well as to abuse one of the holy sites or rituals prescribed in other religions, or insult one of the recognized religions or conduct sins, encourage or promote them.

Drugs: Anyone who uses the information network or an information technology means of trafficking or promoting drugs or psychotropic substances and the like, or how to abuse them or facilitate dealing with them other than those authorized by law, shall be punished with imprisonment.

Money Laundering: Anyone who uses the information network or an information technology means to transfer, transfer or deposit illegal funds with a view to concealing or disguising the illicit origin, as well as concealing or disguising the fact, source, movement, rights or ownership of the illicit funds. As well as the acquisition, possession or use of illicit funds, knowing that their source is illegal.

The court may order that the sentenced person be placed under supervision or supervision or deprived of the use of the information network or electronic information system or placed in a therapeutic shelter or rehabilitation center for such period as the court deems appropriate.
